§ 29-107. Changes of size and use/mixed uses.

(a)

Fire and rescue system impact fees shall be imposed and calculated for the alteration, modification, expansion or replacement of a building or dwelling unit, the redevelopment of property, or the construction of an accessory building if the alteration, expansion or replacement of the building or dwelling unit or the construction of an accessory building results in a land development activity determined to increase the number of dwelling units.

(b)

If application is made for a building permit for a mixed use building (residential and other use[s]), the impact fee shall be determined by apportioning the space within the mixed use development and determining the number of dwelling units and amount of square footage of non-dwelling unit construction that will occur.
