§ 29-108. Payment.

  • (a)

    Except as otherwise provided in this article, prior to the issuance of the certificate of occupancy, an applicant shall pay the appropriate impact fee as set forth in this article.

    (1)

    The three-percent administrative fee shall be waived when fire and rescue system impact fee is paid at the time of the issuance of the building permit.

    (b)

    The impact fee shall be paid directly to the collection agency.

    (c)

    The payment of the impact fee shall be in addition to any other fees, charges or assessments due for the issuance of a building permit or certificate of occupancy.

    (d)

    The obligation for payment of the impact fee shall run with the land. However, this section shall not be construed to relieve an applicant of any responsibility or liability whatsoever.

    (e)

    If a building permit expires and no construction has been commenced, then the fee payer shall be entitled to a refund of the impact fee paid if paid at time of permit issuance.
