§ 25-3. Fire safety and rescue.

  • (a)

    Creation of the City of Palm Coast Fire Rescue Department/Fire Rescue Service Area. There is hereby created and established within the City of Palm Coast governmental structure a City of Palm Coast Fire Rescue Department. There is hereby created and established within the City limits of the City of Palm Coast, as they may be from time-to-time revised and amended in accordance with the controlling provisions of Florida law, a City of Palm Coast Fire Rescue Service Area which shall be consistent with the City limits of the City of Palm Coast.

    (b)

    Ratification of prior acts. All actions taken by the City Council of the City of Palm Coast relative to the City of Palm Coast Fire Rescue Department prior to the effective date of this section and all actions of the City of Palm Coast Fire Rescue Department occurring prior to the effective date of this section are hereby ratified and affirmed.

    (c)

    Operations of outside agencies within City limits. With the exception of the Division of Forestry of the Florida Department of Agriculture and Consumer Services, and other governmental agencies acting under that Department's authority under Chapter 590, Florida Statutes, the only situations in which outside governmental agencies may enter the City limits of the City of Palm Coast to provide fire rescue fire suppression, basic life support, advanced life support, public education, code enforcement, hazardous material response and mitigation, training, testing and other emergency and public safety response functions shall be when the City of Palm Coast Fire Rescue Department formally requests the other agency to provide services within the City of Palm Coast through the City's Fire Chief, or designee, or pursuant to the terms and conditions of a first response or mutual aid agreement between the City of Palm Coast and the other governmental agency as approved by the City Council of the City of Palm Coast. It is prohibited and unlawful to interfere with the operations of the City of Palm Coast Fire Rescue Department within the City limits of the City of Palm Coast. The provisions of this section shall not apply to ambulance service.

    (d)

    Penalties. The City of Palm Coast may pursue any code enforcement action available under controlling state law and any legal remedy available to the City to include, but not be limited to, a fine not exceeding $500.00 unless otherwise authorized by state law or by imprisonment for a term not exceeding 60 days unless otherwise authorized by state law, or by both such fine and imprisonment.
