§ 44-152. Definitions.

  • The following words and phrases, when used in this article, shall have the following meanings except where the context clearly indicates a different meaning:

    Automobile means a four door, full-sized passenger vehicle capable of seating four to six adults.

    Cause to be operated means a person who either (i) provides lease or non-lease vehicles to a driver to be used or operated as a vehicle for hire or (ii) operates a vehicle for hire as a single unit permittee, or (iii) operates a central dispatch for one or more vehicles for hire.

    City means the City of Palm Coast, Florida.

    City Council means the City Council of the City.

    Compensation means any fare, reward, tip, donation, or other thing of value which a driver or owner of a vehicle accepts or receives or offers to accept or receive in return for furnishing such service.

    Driver means any person operating or in charge of a vehicle for hire.

    Driver permit means a permit issued pursuant to this article which entitles a person to drive or operate a vehicle for hire within the jurisdictional limits of the City.

    Employee means any manager, dispatcher, mechanic, driver, contract driver, agent, or other individual who is compensated by a certificate holder in the conduct of its business.

    Limousine means a luxury sedan or luxury van or a motor vehicle that is a chauffeur-driven passenger vehicle which has been built or modified-for-the-purpose as a limousine on an automobile chassis of a luxury sedan (e.g., formal or extended limousine).

    Manifest means the daily record prepared by the driver for the vehicle for hire that he or she operates.

    Meter or taxicab meter means any mechanical, digital or electronic device which services and monitors the distance, time and mileage to determine the fare to be charged a passenger of a vehicle for hire.

    Motor vehicle means a vehicle that is motorized or self-propelled by power other than muscular power or by animals, but does not include traction engines, road rollers, bicycles, mopeds or motorcycles.

    Operate or operation means providing vehicle for hire services by the (i) vehicle driver or (ii) vehicle permit holder.

    Owner means the person to whom a certificate has been issued.

    Passenger vehicle means a motor vehicle used for the transportation of persons.

    Permit means the permit issued pursuant to this article which grants the privilege to operate as a vehicle for hire service or a driver within the jurisdictional limits or upon the public roadways of the City.

    Permit holder means any person who holds a permit for the operation of any category of vehicle for hire within the jurisdictional limits of or upon the public roadways of the City. For purposes of interpretation within this article, the term permit holder includes any agent, employee or any person acting with the permit holder's knowledge, consent or permission, whether express or implied. The term permit holder also includes a taxicab permit holder.

    Person means an individual, firm, partnership, corporation or association, however organized, and by whatever name and existing in whatever form.

    Prior calendar period or prior period means span of time from the last calendar year (January 1 to December 31) in which new permits were issued through the calendar year immediately preceding the current calendar year.

    Scheduled means the transportation of persons on pre-determined points of origin, destination, or schedules of service.

    Scheduled service means operating on a time schedule and/or a fixed route. Services are typically pre-arranged and pre-sold which means prior to the arrival of the passenger at the place of origin for the vehicle trip. The driver and the vehicle shall remain with the hiring party during the period for which the driver and the vehicle have been hired.

    Shuttle service means a chauffeur-driven passenger vehicle providing scheduled vehicle for hire services.

    Statistical Metropolitan Area (SMA) means all of the land area within the City limits of the City.

    Taxicab means any vehicle for hire that solicits to carry, attempts to pick up, or picks up one or more persons for transportation from one place to another for a fee. This term excludes buses with seating capacities of 16 or more passengers (including the driver) operating upon fixed routes and between fixed termini. This term also excludes charter services or limousine services. The terms taxicab, taxi, and cab are synonymous. Evidence of intent to operate as a taxicab may include, but is not limited to, markings on a vehicle or sign, beckoning from or near a vehicle to pedestrians, or parking or stopping in a marked taxi stand.

    Unsafe means that the condition of the vehicle, whether a major violation or defect or an aggregate of minor defects, could reasonably pose a safety or health risk to the traveling public.

    Van means a passenger vehicle recognized as either a mini-van, full-size passenger van, or a passenger vehicle on a van or truck chassis. The term shall not include a cargo or panel van.

    Vehicle for hire means any passenger vehicle engaged in the transportation of persons from or entirely within the City limits of the City with the intent to receive direct or indirect compensation for providing such transportation.

    Vehicle for hire administrator means the person who has been designated, by the City Manager, to administer, enforce, regulate and interpret the provisions of this article.
