§ 16-203. Local preference in purchasing and contracting.

  • (a)

    In bidding for, or letting contracts for procurement of, supplies, materials, equipment and services, as described in the purchasing policies of the City, the City Council, or other authorized purchasing authority, may give a preference to local businesses in making purchases or awarding contracts.

    (b)

    If a local business is located within the City Limits of the City, that business shall receive the bid preference set forth in this article; provided, however, that, if a local business located within the City Limits of the City is not a bidder, and a local business which is located within Flagler County is a bidder, that business shall receive the bid preference set forth in this article.

    (c)

    The bid preference to be awarded in this article shall be in an amount not to exceed five percent of the local business' total bid price if the cost differential does not exceed $10,000.00 for procurement activities in amounts over $30,000.00, or three percent if the cost differential does not exceed $900.00 for procurement activities in amounts more than $3,000.00, but less than $30,000.00.

    (d)

    The total bid price shall include not only the base bid price, but also all alterations to that base bid price resulting from alternates which were both part of the bid and actually purchased or awarded by the City Council or other appropriate authority.

    (e)

    In the case of requests for proposals or qualification, letters of interest, or other solicitations and competitive negotiations and selections in which objective factors are used to evaluate the responses, local businesses shall be assigned five percent of the total points of the total evaluation points. The same preferences set forth in subsection (b) shall be applied in the same manner.
